Introduction

Corkified is an online platform facilitator that enables its users to receive selected, curated content on the wines and wine related, maintain an automated digital wine catalogue, and verify the authenticity of a particular wine (“Services”) and receive wine information updates via our mobile application (“Corkified App”).

This Privacy Policy applies to all users of Corkified App and describes how and when Corkified collects, uses and shares your personal information when you use our Services. Your personal data will be processed in compliance with the European General Data Protection Regulation.

The Data Controller is CORKIFIED, UNIPESSOAL LDA., a Portuguese incorporated company, taxpayer no. 518443590 based in Rua Artilharia 1, n.º 51, edifício 1, 1º andar, 1250-038 Lisboa. This entity is responsible for the treatment of the personal data collected under this Privacy Policy. Information we collect

The information we collect includes information you knowingly and actively provide us when using Corkified, as well as any information sent automatically by your devices in the course of accessing this platform.

When using Corkified the following information may be collected: Name, email, date of birth and address.

Purpose and legal basis for collecting and processing your personal data

We only collect and use your personal information when we have a legitimate reason for doing so. Therefore we only collect personal information that is reasonably necessary to provide our Services to you. The processing of your personal data is performed on the legal basis of the fulfilment of our contractual obligations when delivering Corkified Platform to you, as well as your freely given consent provided when signing up to the Corkified Platform. The collection of personal data will occur under two distinct circumstances:

When signing up: By registering to Corkified, you provide certain information, including your email, first and last name, birthdate and a consent to share your personal data with the Corkified Platform. All personal data will remain visible only within your private user account details. Users will have the ability, at any time, to modify their account information, including their name, address, and other details. The user can also request the removal of its account information following a process in Corkified platform.

When using Corkified: We use cookies to enable Corkified to provide you with a personalized experience. A cookie is a small piece of data that our website stores on your device, and accesses each time you visit, so we can understand how you use our platform. This helps us serve you content based on preferences you have specified.
When you enter Corkified, we may collect information about you that allows us to identify your device. The information is used to customize and improve our content on Corkified and to get statistical information (not personal information), such that we can provide you with the best possible experience. If you choose not to accept cookies at all you may not be able to use all the Services of Corkified.

DISCLOSURE OF PERSONAL INFORMATION TO THIRD PARTIES

We may disclose your anonymized personal information to the following subjects:

-  a parent, subsidiary, or affiliate of our company;
-  third party service providers for the purpose of enabling them to provide their services, for example, IT service providers, data storage, hosting and server providers, advertisers, or analytics platforms;

-  our existing or potential agents or business partners;
-  courts, regulatory authorities, and law enforcement officers, as required by law, in connection with any actual or prospective legal proceedings, or in order to establish, exercise, or defend our legal rights;

The personal information we collect is stored and/or processed in Europe, where we or our partners, affiliates, and third-party providers maintain facilities. Please be aware that the locations to which we store, process, or transfer your personal information may not have the same data protection laws as the country in which you initially provided the information. If we transfer your personal information to third parties in other countries:

-  we will perform those transfers in accordance with the requirements of applicable law and,
-  we will protect the transferred personal information in accordance with this Privacy Policy.

Your rights

Right to be forgotten: If we receive your personal information, you have the right to have your data erased and eliminated.
Please contact us to deactivate your account and your data will be queued for deletion. In case you want to exercise your right to be forgotten, please be aware we may need to request specific information from you to help us confirm your identity.

Right to rectification: If you believe that any information, we hold about you is inaccurate, out of date, incomplete, irrelevant, or misleading, please contact. We will take reasonable steps to correct any information found to be inaccurate, incomplete, misleading, or out of date.

Right to data portability: You have the right to request that all personal data concerning you will be provided to you. Whenever technically possible, you also have the right to request the transmission of your data to another controller.

Right to access: You can access the information you provided to us by editing your profile and adjusting your account settings. You also have the right to obtain a copy of the personal data free of charge.

Objecting to, Restricting, or Withdrawing your Consent: You have the right to object to the processing of your personal data or to request that we restrict such processing in certain circumstances. Additionally, you may withdraw your consent to the processing of your personal data at any time where consent is the lawful basis for processing. Any withdrawal of consent will not affect the lawfulness of processing based on consent before its withdrawal. You can at any time withdraw your consent by deleting your profile or delete your account in the in-app settings.

Complaints: If you believe that we have breached a relevant data protection law and wish to make a complaint, please contact us and provide us with full details of the alleged breach. We will promptly investigate your complaint and respond to you, in writing, setting out the outcome of our investigation and the steps we will take to deal with your complaint. You also have the right to contact a regulatory body or data protection authority in relation to your complaint, namely the “Comissão Nacional de Protecção de Dados” (https://www.cnpd.pt/)

How long we keep your personal information

Corkified stores your Personal Data only for the period of time necessary to execute the specific purposes for which they were collected. However, Corkified may be obliged to store some Personal Data for a longer period, taking into consideration factors such as:

-  Legal obligations, under the laws in place, to store Personal Data for a given period;
-  Contractual obligations and/or legitimate interest of Corkified;
-  Terms of prescription, under the laws in place;
-  Guidelines issued by the competent data protection authorities.

Effectiveness and Amendments to this Policy

This policy is effective from November 2024.
At our discretion, we may change this Privacy Policy to reflect updates to our business processes, current acceptable practices, or legislative or regulatory changes.

Whenever Corkified has already collected Personal Data about you and/or whenever required by law, Corkified may take additional measures to inform you about any material alterations and may ask you to agree to these alterations.
